A paternity action is brought when the parents of a child are unmarried and the Father’s name does not appear on the birth certificate. This action would deal with the issues of establishing paternity; child custody, support and visitation. Most of the time, a DNA test (genetic marker test) is used to conclusively establish paternity.
If the Father’s name does appear on the Birth Certificate, then an action for Custody, Support and Visitation would be filed.
